Merkats — Terms of Service

By creating a Merkats account or using the app you agree to these terms. If you do not agree, do not use Merkats.

1. Who can use Merkats

You must be at least 13 years old. You are responsible for your account and for keeping your password secure.

2. Your content

You keep ownership of the messages, photos, profile details, and other content you post ("your content"). By posting it you grant Merkats a limited licence to store and display it to the people you share it with (your communities, direct-message recipients) so the app can function.

3. Acceptable use — zero tolerance for objectionable content

You agree not to post, send, or share content that is:

• harassing, bullying, threatening, or hateful;
• sexually explicit, or that sexualises minors;
• violent or that promotes self-harm;
• spam, scams, or deceptive;
• unlawful, or that infringes someone else's rights;
• impersonating another person.

You also agree not to harass or abuse other users, or to misuse the app (scraping, automated access, attempts to break security or access other users' data).

4. Reporting and enforcement

Every message and profile can be reported from inside the app, and you can block any user. We review reports within 24 hours. Content that violates Section 3 is removed, and the responsible account may be suspended or permanently deleted without notice. We may remove content or terminate accounts at our discretion to keep the community safe.

5. Termination

You can delete your account any time from Profile → Delete account. We may suspend or terminate your access for violations of these terms.

6. Use at your own risk

You use Merkats, and interact with other users, entirely at your own risk.

Merkats is a scheduling and communication tool. It does not vet users, verify identities, supervise communities, prepare or inspect food, or take part in any plan, meal, chore, payment, or meeting you arrange through it. In particular:

• Other people. We do not screen or background-check users. You are responsible for deciding whom to trust, share information with, add to a community, or meet in person.
• Food and allergies. Dietary tags, allergen labels, ingredient lists and recipe links are entered by users and may be wrong, incomplete, or missing. Do not rely on Merkats for allergy or safety decisions — confirm directly with whoever prepared the food.
• Meeting in person and arrangements. Any in-person meeting, cost-sharing, chore swap, or other arrangement is strictly between the users involved.
• Content and conduct. Messages, photos, and profiles are created by users. We are not responsible for them, and moderation is not a guarantee that you will not encounter something objectionable.

7. Disclaimer of warranties

Merkats is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, reliability, availability, or non-infringement. We do not warrant that the app will be uninterrupted, secure, or error-free.

8. Limitation of liability

To the fullest extent permitted by law, Merkats and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from: your use of or inability to use the app; the conduct, content, or omissions of any user; any food, allergen, health, or safety issue; any in-person meeting or arrangement; or any unauthorized access to your data. Our total liability for any claim relating to the app will not exceed USD 50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law.

9. Indemnification

You agree to indemnify and hold harmless Merkats and its operator from any claim or demand arising out of your content, your use of the app, or your violation of these terms or of another person's rights.

10. Changes

We may update these terms; material changes will be noted in the app.
